What is a Patent?
A patent is an exclusive right granted by the government to an inventor for a limited period in exchange for public disclosure of the invention. It gives the inventor the right to exclude others from making, using, selling, or importing the invention without permission.
In India, patents are governed by the Patents Act, 1970 (amended in 2005) and administered by the Indian Patent Office under the Office of the Controller General of Patents, Designs & Trade Marks. A patent is valid for 20 years from the date of filing.

What Can Be Patented in India?
- Products — new and inventive physical items such as machines, devices, chemicals, pharmaceuticals, and manufactured goods.
- Processes or Methods — innovative manufacturing processes, industrial methods, or new field techniques.
- Machines — new and useful machines or mechanical inventions with innovative mechanisms or components.
- Manufactured Articles — items created through a novel process or having unique features.
- Chemical Compounds — new and inventive chemical compounds including pharmaceuticals.
- Biotechnological Inventions — genetic engineering, gene sequencing, and new biotechnological processes.
- Software-Implemented Inventions — software and computer-related inventions that demonstrate novelty and an inventive step (not software per se).
What Cannot Be Patented in India?
- Inventions that violate natural laws or are harmful to humans, animals, plant life, or the environment.
- Discoveries of scientific principles, abstract theories, or naturally occurring substances.
- Mathematical methods, mental acts, and business methods.
- Computer programs per se and literary, dramatic, musical, or artistic works.
- Simple mixtures combining properties of components; basic rearrangements of common devices.
- Methods of treatment of human or animal body (medicinal, surgical, curative, diagnostic, therapeutic).
- Methods for agriculture or horticulture.
- Plants and animals (other than microorganisms); seeds, varieties, and species.
- Topography of integrated circuits.
- Inventions related to atomic energy.
Documents Required
- Form-1 — Patent Registration Application.
- Form-2 — Complete Specification (or Provisional Specification if complete is not ready).
- Form-3 — Statement and Undertaking under Section 8 of the Patents Act, 1970.
- Form-5 — Declaration of Inventorship.
- Form-26 — Power of Authority if filed through a patent agent or attorney.
- Form-28 — For Small Entity (if applicable).
- Priority documents for convention (Paris Convention) or PCT national phase applications — to be submitted within 18 months from the priority date.
- Permission from the National Biodiversity Authority if the application relates to biological material obtained from India.
- PAN Card and address proof of the inventor/applicant.
Patent Registration Process
- Prior art search to assess novelty and patentability of the invention.
- Drafting of patent specification — provisional (without claims) or complete (with claims).
- Filing patent application (Form-1 + Form-2) with the Indian Patent Office (branches in Delhi, Mumbai, Chennai, Kolkata).
- If provisional specification is filed, complete specification with claims must be filed within 12 months.
- Publication of the application after 18 months from filing date (or earlier on request via Form-9).
- Request for examination (Form-18) must be filed within 48 months of the priority/filing date.
- Respond to examination report (objections) within 12 months of issuance.
- Grant of patent after all objections are resolved to the examiner's satisfaction.
Patent Renewal
- A patent must be renewed annually to remain in force.
- Renewal fees become due at the end of the 2nd year from the date of patent registration.
- Failure to pay renewal fees results in the patent lapsing and entering the public domain.
- A lapsed patent can be restored by filing Form-15 (restoration application) within 18 months from the date the patent lost its effect.
