What is Shop & Establishment Registration?

The Karnataka Shops and Commercial Establishments Act, 1961 was enacted to regulate the working conditions of employees in commercial undertakings, shops, and other establishments in Bangalore and Karnataka. It ensures fair treatment of employees by setting guidelines for working hours, annual leave with wages, employee compensation, and the employment of women and minors.

Registration under this Act is mandatory for all businesses operating from commercial premises in Bangalore and Karnataka. The registration must be obtained within 30 days of commencing business operations. It serves as primary proof of business existence and is required for opening a current bank account, obtaining other licences, and hiring employees.

Shop & Establishment registration is also a prerequisite for obtaining other government registrations such as GST, Professional Tax, and FSSAI. Employers must maintain accurate records of employee attendance, wages, working hours, and leave, and submit an annual report to the Labour Department by 31st January each year.

Who Needs Shop & Establishment Registration?

  • All shops and retail commercial establishments.
  • Restaurants, hotels, dhabas, and eating establishments.
  • Theatres, cinemas, and public entertainment venues.

  • Any establishment engaged in trade or services within notified areas of Bangalore and Karnataka.
  • Every business must register within 30 days of commencing operations — failure to do so may result in penalties under the Karnataka Shop Act.

Documents Required

  • For Sole Proprietorship: PAN card, address proof (utility bill or rental agreement), rental agreement (if applicable), and passport-sized photograph of the owner.
  • For Partnership Firms: PAN card of the firm, Partnership Deed, address proof of all partners, rental agreement, and passport-sized photographs of all partners.
  • For Private Limited Companies: PAN card of the company, Certificate of Incorporation, MOA and AOA, address proof of directors, rental agreement, and passport-sized photographs of all directors.
  • All documents must be submitted along with the completed application form on the e-Karmika portal.

Registration Process (e-Karmika Portal)

  • Visit the official e-Karmika portal and select New Registrations.
  • Fill out the registration form with business name, owner details, and employee count. A username and password will be sent to your registered email and mobile number.
  • Log in and complete the application form, attaching all required documents.
  • Obtain a challan and pay the registration fee online — fees vary based on the number of employees.
  • Submit the documents in physical form to the relevant Labour Department office after payment.
  • Once verified, receive the Shop & Establishment licence in Bangalore confirming legal registration.

Key Provisions of the Karnataka Shops & Establishments Act

  • Child Employment: Children below 14 are prohibited from working in any establishment.
  • Women & Young Individuals: Women and young individuals (aged 14–18) cannot work at night. IT and BT firms may apply for exemptions for women to work after 8 PM.
  • Working Hours: Employees can work up to 9 hours a day or 48 hours a week. Overtime must be compensated at twice the regular wage rate. Employees must not work more than five continuous hours without a break.
  • Weekly Holidays: Businesses must close at least once a week (usually Sundays). Some businesses such as medical shops and hotels may be exempt.
  • Leave Entitlement: Employees earn one day of paid leave for every 20 days of work. Young workers (14–18 years) earn one day of paid leave for every 15 days worked.
  • Record-Keeping: Employers must maintain accurate records of attendance, wages, working hours, and leave, and submit an annual report by 31st January each year.

Exemptions from Registration

  • Government offices (State or Central) and local authorities, except commercial undertakings.
  • Services such as railways, postal services, water transport, telegraph, telephone, and utilities providing water, power, and sanitation.
  • Railway dining cars.
  • Medical institutions caring for disabled or mentally unfit individuals.
  • Banking establishments with fewer than three employees.
  • Employees in managerial positions in any establishment.
  • Individuals employed in intermittent work such as drivers, caretakers, and watchmen.

Validity & Renewal

  • The Shop & Establishment certificate in Bangalore is valid for five years.
  • Business owners must renew the certificate at least one month before it expires.
  • Renewal can be completed online through the e-Karmika portal by submitting the application and paying the renewal fee.
  • After renewal, a fresh certificate is issued confirming continued legal registration.
