What is Design Registration?

Design registration protects the visual features of a product — its shape, configuration, pattern, ornamentation, or composition of lines and colours applied to any article. It is governed by the Designs Act, 2000 and administered by the Office of the Controller General of Patents, Designs & Trade Marks.

A registered design gives the owner exclusive rights to use the design commercially and prevents others from copying, imitating, or selling products with the same or similar appearance without permission.

What Can Be Registered as a Design?

  • Shape or configuration of a product (3D designs).
  • Pattern or ornamentation applied to a product (2D designs).
  • Composition of lines or colours applied to any article.

  • Name and complete address of the applicant.
  • Nature/status of the applicant — specify whether individual, company, partnership, small entity, etc.
  • Startup Registration Certificate (if the applicant is a startup).
  • Description of the article to which the design pertains, along with its classification.
  • Minimum 4 visual representations (images or drawings) showing the article from all angles — front, back, side, and perspective views.
  • Statement of novelty describing the unique features of the design.
  • Disclaimer (if any part of the design is not claimed).
  • Priority document if claiming priority from a foreign application.
  • Power of Attorney if filed through an agent.

Who Can Apply for Design Registration?

  • Individuals, their legal representatives, or assignees — either individually or jointly.
  • Firms, partnerships, small entities, and corporate bodies.
  • Non-Resident Indians (NRIs) — must apply through their agent or legal representative in India.
  • Startups — eligible as a distinct applicant category with reduced fees (must provide Startup Registration Certificate).

What Cannot Be Registered as a Design?

  • Literary or artistic works such as books, calendars, stamps, and tokens (protected under copyright).
  • Buildings and structures — architectural works are not eligible for design registration.
  • Geographical representations such as maps.
  • National symbols — designs that imitate or resemble national flags, emblems, or official signs of any country.
  • Designs that conflict with public morals, sentiments, or the security of India.

Design Registration Process

  • Prior art search to assess novelty and registrability of the design.
  • Prepare representations/drawings and statement of novelty.
  • File application with the Design Office (Patent Office).
  • Examination by the Design Office — objections addressed if raised.
  • Upon acceptance, the design is published in the Official Gazette — public can raise objections during this period.
  • If no objections or objections resolved, Design Registration Certificate is issued (valid for 10 years).
  • Renewal at the end of 10 years for an additional 5-year term.
